Terms of Service

These Terms govern your use of aerodule.com and everything we provide through it — the engineering models and the API (the “Services”). Aerodule LLC is a North Carolina limited liability company (“Aerodule”, “we”, “us”).

By using the Services you agree to these Terms.

Anyone may run our engineering models and view the results, without an account and without charge. Uploading the airfoil and polar files a model needs in order to run is also free. A paid subscription adds two things: exporting and importing results as files, and access to our API. The paid tiers differ only in the size of the API allowance included.

We may add, change, or remove features at any time. If we materially reduce something you are paying for, we will tell you first — see sections 4.5 and 7.4.

You must be at least 18 years old to create an account or purchase a subscription. By using the Services you confirm that you are.

How we handle personal information is described in our Privacy Policy at https://www.iubenda.com/privacy-policy/65471071, which forms part of these Terms.

You agree that we may communicate with you electronically, and that notices and disclosures we send by email satisfy any requirement that they be in writing. Transactional messages about your subscription and account are part of the Services; marketing email is optional and every such message includes an unsubscribe link.

Our models produce estimates using established but idealized engineering methods. Results are estimates and may differ from reality. We cannot guarantee accuracy for any particular design, and the range of designs the models will accept is far wider than the range they were validated against.

You are solely responsible for every design, build, purchasing, and flight decision you make. Verify our outputs by other means before relying on them. Do not use them as the sole basis for anything that could hurt someone.

We do not check your inputs and cannot tell whether they are physically sensible. Wrong inputs produce wrong outputs that may still look plausible.

Optional sub-models run only when you supply their inputs. If you leave a block out, that physics is absent from the result — not defaulted to something reasonable.

Unmanned aircraft and their components can cause serious injury, death, and property damage. You assume all risk from designing, building, testing, and operating anything informed by our models or their outputs, and you are responsible for complying with every law and regulation that applies to you, including aviation and radio regulations and any competition rules.

Our outputs are intended for experimental, educational, and hobby use. They are not qualified, certified, or approved for use on manned aircraft or in any certified aviation application, and we do not represent that they are suitable for any particular purpose. Determining whether a result is appropriate for your design, including applying appropriate safety factors, is your responsibility.

Some jurisdictions do not allow certain disclaimers, so parts of this section may not apply to you.

We make no commitment about uptime, response time, or availability. We may suspend, interrupt, or discontinue any part of the Services at any time, including for maintenance, and we are not liable for any resulting loss.

You acknowledge that electronic communications, databases, and websites are subject to errors, malfunctions, tampering, and unauthorized access. We will take reasonable precautions against such events but do not guarantee they will not occur.

You may not:

• Use the Services for any unlawful purpose or in breach of any law that applies to you;
• Resell, redistribute, sublicense, or provide the Services or their outputs to third parties as a service;
• Access the models by automated means except through the API under a paid subscription;
• Create multiple keys or accounts, or use any other method, to exceed a rate limit or allowance;
• Use the Services to build a competing product or service;
• Reverse engineer, decompile, or attempt to derive the source, methods, or underlying data of the Services;
• Interfere with the Services or attempt to gain unauthorized access to any part of them, any account, or any connected system;
• Introduce malicious code, or place disproportionate load on the Services.

We may block, suspend, or terminate access we reasonably believe breaches this section, with or without notice.

The Services, including the models, their methods and implementations, our documentation, the Aerodule name and logo, and the content of the site, belong to us. These Terms grant you a limited, non-exclusive, non-transferable right to use the Services and nothing more.

Your design inputs remain yours. The outputs a model produces from your inputs are yours to use, including in competition or academic reports.

If you send us feedback or suggestions, we may use them freely and without obligation to you.

Our software, outputs, and documentation may be subject to United States export control laws. You agree not to export, re-export, or transfer anything obtained from us in violation of those laws.

You represent that you are not located in, and are not a national or resident of, any country subject to comprehensive U.S. sanctions; that you are not on any U.S. government restricted-party list; and that you will not use anything obtained from us for any prohibited end use.

You may stop using the Services at any time and cancel your subscription as described above. We may suspend or terminate your access for breach of these Terms, non-payment, or where required by law.

You can delete your account yourself. Doing so cancels any active subscription. We keep transaction and usage records afterwards as business and tax records, without linking them to you.

Sections 5, 6, 8, 9, 11, 14, 15, 16, and 18 survive termination.

Some jurisdictions do not allow these limitations, so parts of this section may not apply to you. Nothing here limits liability that cannot lawfully be limited.

These limitations allocate risk between us and are a basic part of the bargain. They apply even if a limited remedy fails its essential purpose.

You will indemnify and hold harmless Aerodule and its members, managers, employees, and contractors against any claim, loss, liability, or expense (including reasonable legal fees) arising from your use of the Services, your breach of these Terms, your violation of any law or third-party right, or your design, construction, testing, or operation of anything informed by our models or their outputs.

We are not liable for any delay or failure to perform caused by circumstances beyond our reasonable control, including war, civil unrest, fire, flood, natural disaster, epidemic, labor disturbance, acts of any governmental body, power or network failure, or failure of a third-party service on which the Services depend. Where such a circumstance is of a lasting nature, our affected obligations are suspended for its duration.

We may update these Terms. We will post the revised version with a new date, and for material changes we will make reasonable efforts to notify account holders. Continued use after the effective date means you accept the update. A dispute is governed by the version in effect when it arose.

These Terms are governed by the laws of the State of North Carolina, without regard to its conflict of laws rules. Any dispute will be brought exclusively in the state or federal courts located in Wake County, North Carolina, and both parties consent to jurisdiction there.

Either party may bring a qualifying individual claim in small claims court instead.

These Terms and our Privacy Policy are the entire agreement between us about the Services. If any provision is unenforceable, it is limited or severed and the rest stands. Our failure to enforce a provision is not a waiver of it. You may not assign these Terms without our consent; we may assign them in a merger, acquisition, or sale of assets. Nothing here creates a partnership, agency, or employment relationship.
